These Terms of Service ("Terms") govern your access to and use of the Ticket King Discord bot ("Bot"), the website at https://ticketking.xyz ("Website"), the dashboard, and all related services (collectively, the "Service") provided by Ticket King ("we," "us," or "our"), operated in the United States. These Terms apply to all users of the Service, including Discord server administrators who install the Bot and end users who interact with ticket channels managed by the Bot.
By accessing the Website, adding the Bot to a Discord server, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are adding the Bot to a Discord server as an administrator, you represent that you have the authority to bind the server and its members to these Terms to the extent permitted by law.
If you do not agree to these Terms, you must not use the Service. Your continued use of the Service following any changes to these Terms constitutes acceptance of those changes.
Age Requirement: You must meet the minimum age requirements set by Discord's Terms of Service to use the Service. For clarity, this means you must be at least 13 years of age, or the minimum age of digital consent in your jurisdiction if higher (such as 16 in certain EU member states). By using the Service, you represent that you meet these age requirements. We rely on Discord's age verification and Terms of Service to enforce these thresholds.
Ticket King is a Discord bot that provides ticket management functionality for Discord servers. The Service includes creating and managing support ticket channels; collecting, processing, and persistently storing ticket messages (including message content, metadata, and uploaded files); displaying ticket messages in real time to authorized server staff through the web dashboard while tickets are open; generating and storing ticket transcripts after tickets are closed; providing a web-based dashboard for server configuration, ticket management, and transcript viewing; and displaying ticket transcripts on the Website. The Service may also include premium features available through paid subscriptions.
The Service is provided on an "as available" basis. We do not guarantee any specific level of uptime, availability, or performance. We do not offer a Service Level Agreement (SLA) and make no commitments regarding uninterrupted or error-free operation of the Service. Scheduled or unscheduled maintenance, updates, and system changes may temporarily affect the availability of the Service.
No Data Loss Guarantee: While we perform daily backups on a 30-day rotation cycle, we do not guarantee against data loss. Backup failures, corruption, or other unforeseen circumstances may result in the loss of data, including ticket transcripts, server configurations, and uploaded files. You acknowledge that the Service should not be relied upon as a sole repository for critical data and that you are responsible for maintaining your own independent records where data preservation is essential.
Third-Party Dependencies: The Service depends on third-party platforms and infrastructure, including Discord, cloud hosting providers, content delivery networks, and object storage providers. We are not responsible for any disruption, degradation, or limitation of the Service caused by changes to, outages of, or discontinuation of any third-party platform, including the Discord API or Discord's bot platform.
If you add the Bot to a Discord server as an administrator, you agree to the following:

Account Security: Your access to the Service is authenticated through Discord OAuth. You are solely responsible for maintaining the security of your Discord account, including your login credentials and any authorized sessions. Ticket King is not liable for any unauthorized access to your data or the Service resulting from the compromise of your Discord account or credentials. You must notify us promptly if you believe your account has been accessed without authorization.
Discord Account Dependency: Your use of the Service, including any active premium subscription, is tied to your Discord account. If your Discord account is suspended, disabled, or terminated by Discord for any reason, your access to the Service will also be affected. We are not responsible for any loss of access or functionality resulting from actions taken by Discord against your account. Premium subscriptions will not be paused, refunded, or transferred in the event of a Discord account suspension or termination, except as may be required by applicable law.
By sending messages or uploading files in a ticket channel managed by Ticket King, you grant Ticket King a limited, non-exclusive, worldwide, royalty-free, sublicensable (solely to our service providers for the purpose of operating the Service) license to store, reproduce, and display your messages and uploaded files solely for the purpose of providing the Service, including real-time ticket message display on the web dashboard and the transcript service. This license:
Ticket transcripts are generated on a best-effort basis. Transcripts may not capture every message or attachment, including messages deleted before the Bot processes them, content sent during service outages or rate-limited periods, or certain message types not supported by the Bot. Ticket King is not liable for incomplete, missing, or inaccurate transcript data. Transcripts should not be relied upon as the sole record of any communication.
All materials and content on Ticket King's Website and within the Service, including but not limited to text, graphics, logos, brand marks, images, photographs, illustrations, icons, animations, visual designs, user interface designs, page layouts, page structures, color schemes, typography, iconography, software, source code, object code, HTML, CSS, JavaScript, and all other code and markup are the property of Ticket King or its content suppliers and are protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.
The overall look and feel of the Website and the Service, including the arrangement and selection of visual elements, the combination of colors, typography, page layout, graphic design, and the overall visual impression conveyed by the Website (collectively, the "Trade Dress"), constitutes the proprietary trade dress of Ticket King and is protected under applicable trade dress and unfair competition laws.
Any use of these materials, including reproduction, modification, distribution, republication, display, transmission, or creation of derivative works, without the prior written permission of Ticket King is strictly prohibited. You may not copy, imitate, or use any of Ticket King's intellectual property, including its Trade Dress, in any manner that is likely to cause confusion, deceive consumers, or misrepresent any affiliation with or endorsement by Ticket King.
Accessing, viewing, or using the Website or the Service does not grant you any ownership interest in, or any license or right to use, reproduce, or distribute, any of Ticket King's intellectual property, except for the limited use license expressly granted in Section 11 of these Terms. All rights not expressly granted herein are reserved by Ticket King.
This section does not apply to user-generated content submitted through ticket channels, which remains the property of its respective authors as described in Section 8.
You are granted a temporary license to access and use the Service for personal or internal business purposes. Under this license, you may not:
Ticket King reserves the right to terminate this license for any violations of these restrictions. Upon termination, your access rights will also be terminated and you must destroy any downloaded materials in your possession.
The visual design, creative works, and overall aesthetic of the Website and the Service represent significant original creative effort and investment by Ticket King. Ticket King claims and reserves all intellectual property rights in the Website's unique visual identity, including its Trade Dress as defined in Section 10.
Protected Elements: The following elements of the Website and the Service are proprietary to Ticket King and are expressly protected under these Terms, applicable copyright law, trade dress law, and other intellectual property laws:
Prohibited Conduct: You may not, and you may not permit or authorize any third party to, copy, reproduce, imitate, replicate, reverse engineer, deconstruct, or create works substantially similar to any of the protected elements listed above, whether in whole or in part, for any purpose whatsoever. This prohibition applies regardless of the method used, including but not limited to manual recreation, use of automated tools, tracing, screen capture, code inspection, or any other means of reproduction.
Without limiting the foregoing, you specifically may not use any element of the Website's design, layout, visual identity, or creative works as a template, starting point, reference design, or source of inspiration for creating any competing product, service, or website, or for any product, service, or website that could reasonably be confused with or mistaken for Ticket King or its Service.
These protections apply to the protected elements both individually and as a collective whole, and regardless of whether any individual element may or may not be independently eligible for copyright registration. The selection, arrangement, coordination, and overall combination of these elements constitutes a copyrightable work and protectable trade dress owned by Ticket King.
Remedies: Any violation of this section constitutes a material breach of these Terms and may cause irreparable harm to Ticket King for which monetary damages alone would be inadequate. In addition to any other remedies available at law or in equity, Ticket King reserves the right to:

Ticket King may from time to time offer features or functionality designated as "beta," "preview," or "experimental" ("Beta Features"). Beta Features are provided on an "as-is" and "as-available" basis without warranty of any kind.
Your use of Beta Features is voluntary and at your own risk. To the maximum extent permitted by applicable law, Ticket King shall not be liable for any loss, damage, or disruption arising from the use of, or inability to use, any Beta Feature.
Access to any Ticket King APIs, including the Bot's command interface, the web dashboard API, and any publicly documented endpoints, is subject to rate limits and usage restrictions. We reserve the right to impose, modify, or enforce rate limits at our sole discretion without prior notice.
Exceeding rate limits or engaging in excessive, automated, or abusive use of the API may result in temporary or permanent restriction of your access. We are not liable for any loss of functionality or data resulting from rate limiting or access restrictions applied to your account or server.
We do not guarantee the availability, stability, or backward compatibility of any API. APIs may be modified, deprecated, or removed at any time without notice. You assume all risk associated with reliance on any API functionality.
Ticket King respects the intellectual property rights of others. If you believe that content hosted on or accessible through the Service infringes your copyright, you may submit a takedown notice in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent. The counter-notification must include: your physical or electronic signature, identification of the material that was removed and the location at which it appeared before removal, a statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification, and your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal courts in the United States. Upon receipt of a valid counter-notification, Ticket King will forward it to the original complainant and will restore the removed material within ten (10) to fourteen (14) business days, unless the original complainant notifies us that they have filed a court action seeking to restrain the alleged infringement.
Repeat Infringers: Ticket King will terminate the accounts or access of users who are determined to be repeat infringers of copyrighted material in appropriate circumstances.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permissible by applicable law, Ticket King disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and completeness.
Ticket King does not warrant that: (a) the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components; (b) the results obtained from the use of the Service will be accurate or reliable; (c) the quality of any content, information, or other material obtained through the Service will meet your expectations; or (d) any errors in the Service will be corrected.
Any material downloaded or otherwise obtained through the use of the Service is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download or use of any such material.
To the maximum extent permitted by applicable law, Ticket King and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service, including without limitation any defamatory, offensive, or illegal conduct of other users or third parties; (c) any content obtained from the Service; (d) unauthorized access, use, or alteration of your transmissions or content; or (e) any other matter relating to the Service.
In no event shall Ticket King's aggregate liability for all claims arising out of or relating to the Service or these Terms exceed the amount you paid to Ticket King in the twelve (12) months preceding the claim, or one hundred United States dollars (US $100), whichever is greater. This limitation applies to all causes of action in the aggregate, including without limitation breach of contract, breach of warranty, negligence, strict liability, and other torts.
The foregoing limitations of liability: (i) shall apply regardless of whether the damages arise from use or misuse of the Service, from inability to use the Service, or from the interruption, suspension, or termination of the Service; (ii) shall apply regardless of the theory of liability, whether based on warranty, contract, tort, strict liability, or any other legal theory; (iii) shall apply even if Ticket King has been advised of the possibility of such damages; and (iv) shall apply to the fullest extent permitted by applicable law. These limitations represent the sole and exclusive remedy available to you in connection with the Service.
You acknowledge and agree that the limitations of liability set forth in this section reflect a fair and reasonable allocation of risk between you and Ticket King, and that these limitations form an essential basis of the bargain between the parties. Without these limitations, Ticket King would not be able to provide the Service on an economically feasible basis.
The foregoing limitations shall not apply to: (a) liability arising from fraud or fraudulent misrepresentation; (b) liability for death or personal injury caused by negligence; or (c) any liability that cannot be excluded or limited under applicable mandatory law.
You agree to indemnify, defend, and hold harmless Ticket King and its affiliates, officers, agents, employees, licensors, and suppliers from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees, court costs, and settlement amounts) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms or any applicable law or regulation; (c) your violation of any rights of any third party, including any intellectual property, privacy, or publicity rights; (d) the content you submit, post, or transmit through the Service; (e) any claim by a third party arising from your use of the Service; (f) any regulatory investigation, inquiry, or enforcement action arising from your use of the Service or your processing of personal data through the Service; or (g) any claim by a data subject or individual whose personal data is processed through your use of the Service.
Ticket King shall have the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims. You shall not settle any claim without our prior written consent.
This section applies to the fullest extent permitted by applicable law. In jurisdictions where indemnification obligations imposed on consumers are restricted or prohibited by mandatory consumer protection law, this section shall apply only to the extent permitted.
Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration conducted on an individual basis, rather than in court. The arbitration shall be administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect. If the AAA is unable or unwilling to administer the arbitration, the parties shall agree on an alternative arbitration provider, or either party may petition a court of competent jurisdiction to appoint an arbitrator. The arbitration shall be conducted in the State of Delaware, United States. The arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.
Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the jurisdiction of such court.
Intellectual Property Exception: Notwithstanding the arbitration provisions above, Ticket King may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights, including but not limited to copyrights, trademarks, trade dress, trade secrets, and other proprietary rights as described in Sections 10, 11, and 12 of these Terms. This exception applies to claims for temporary restraining orders, preliminary injunctions, permanent injunctions, and any other equitable remedies, and such claims are not subject to the arbitration requirement. The filing of any such action shall not constitute a waiver of Ticket King's right to submit any other dispute to binding arbitration.
EU and UK Consumer Rights: If you are a consumer residing in the European Union or the United Kingdom, nothing in these Terms shall limit your rights under mandatory consumer protection laws in your jurisdiction, including your right to bring claims in the courts of your country of residence as provided by Regulation (EU) No 1215/2012 or applicable UK consumer protection legislation.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law provisions. Subject to the dispute resolution provisions above, the state and federal courts located in the State of Delaware shall have exclusive jurisdiction over any disputes arising under these Terms.
Ticket King may access, preserve, and disclose your information, including account data, server configurations, ticket transcripts, and usage logs, if we believe in good faith that such action is reasonably necessary to: (a) comply with applicable law, regulation, legal process, or enforceable governmental request; (b) enforce these Terms, including investigation of potential violations; (c) detect, prevent, or otherwise address fraud, security, or technical issues; or (d) protect the rights, property, or safety of Ticket King, its users, or the public.
Where legally permitted, we will make reasonable efforts to notify affected users of such requests. However, we may be prohibited from providing notice in certain circumstances, including but not limited to emergency situations, court orders that include non-disclosure provisions, or where notice would jeopardize an investigation.
We reserve the right to suspend or terminate your access to the Service and/or your account, without prior notice, if we determine in our sole discretion that you have misused the Service or violated any of these Terms. Misuse includes, but is not limited to, using the Service for any illegal or unauthorized purpose, attempting to access the Service in a manner that violates the rights of any other person or entity, or engaging in any conduct that is harmful to us or others. Upon termination, the provisions of these Terms that by their nature should survive (including, without limitation, intellectual property provisions, warranty disclaimers, indemnification, limitation of liability, and dispute resolution) shall continue to apply.
Termination Consequences: Upon termination for violation of these Terms, the following consequences apply:
The Service operates through Discord's API and is subject to Discord's Developer Terms of Service and Developer Policy. Data obtained through Discord's API ("API Data") is used solely for the stated functionality of the Service as described in Section 3 of these Terms and in accordance with Discord's requirements.
We do not sell, license, or commercialize API Data. We do not share API Data with advertising networks, data brokers, or any monetization services. We do not use message content or other API Data for artificial intelligence or machine learning model training purposes. We do not mine or scrape Discord data. We do not contact users outside of Discord using API Data without their explicit permission. We do not attempt to re-identify, de-anonymize, unscramble, unencrypt, or reverse hash any data obtained through Discord's API. We do not attempt to derive or infer information about users beyond what is directly provided through the API for the stated functionality of the Service.
Discord API Termination: Discord's Developer Terms of Service obligate developers to delete all cached and stored API Data if Discord terminates or revokes their API access. Although we do not anticipate any disruption to the Service, we include this disclosure for transparency regarding that obligation. In the unlikely event that Discord terminates or revokes Ticket King's access to the Discord API, we will comply with Discord's requirements regarding the deletion of API Data. This may require us to delete cached and stored data obtained through the API, including ticket messages, user identifiers, and server configuration data. We will notify affected users and server administrators if such an event occurs and provide information about the impact on the Service.
Cessation of Service: If Ticket King permanently ceases operations, we will provide reasonable advance notice to users and server administrators where possible and will delete all API Data obtained through Discord's API in accordance with Discord's Developer Terms of Service. We will make reasonable efforts to allow server administrators to export their data before deletion occurs.
Our use of API Data is governed by our Privacy Policy, and users retain all rights provided under Discord's Terms of Service.
We may update these Terms from time to time to reflect changes in our Service or applicable laws. We will notify you of material changes by posting the updated Terms on our Website and through an announcement in our official Discord server. For material changes that significantly affect your rights, we will provide at least 14 days' notice before the changes take effect. Your continued use of the Service after such notice constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
These Terms, together with our Privacy Policy, Data Processing Agreement, and any other policies or agreements referenced herein, constitute the entire agreement between you and Ticket King with respect to the Service and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.
Ticket King shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics, pandemics, power outages, internet or telecommunications failures, Discord platform outages or API changes, cyberattacks, or any other force majeure event. During such events, Ticket King's obligations shall be suspended for the duration of the event.
You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Ticket King. Ticket King may assign its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law. Any attempted assignment in violation of this section shall be void.
The failure of Ticket King to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Ticket King. No waiver shall be deemed a further or continuing waiver of such right or provision or any other right or provision.
If you encounter content on the Service, including within ticket transcripts displayed on the Website, that you believe violates these Terms, applicable law, or the rights of any person, you may report it by contacting us at [email protected] with the subject line "Content Report." We will review all reports and take appropriate action, which may include removing the content and/or suspending access. Content that may constitute child sexual abuse material (CSAM) or other illegal content will be reported to the appropriate authorities, including the National Center for Missing & Exploited Children (NCMEC) as required by federal law.

Refund Exclusions: Notwithstanding any refund policy, no refunds will be issued in the following circumstances:
You acknowledge that no system is completely secure and that there are inherent risks associated with using any internet-based service, including the potential for unauthorized access to your data, data loss, service interruptions, and other unforeseen issues. By using the Service, you assume all risks associated with your use of the Service, including any risks arising from the storage, display, or transmission of your data through the Service. You are solely responsible for evaluating the adequacy and suitability of the Service for your particular needs and for implementing appropriate safeguards, including maintaining independent backups of any data you consider critical.
Ticket King does not monitor, screen, edit, or control the content submitted by users through ticket channels, nor do we have any obligation to do so. We are not responsible for the accuracy, completeness, legality, or appropriateness of any content submitted by users. You acknowledge that you may be exposed to content that is inaccurate, offensive, or otherwise objectionable.
Ticket King shall not be liable for any content submitted by users, including any errors or omissions, or for any loss or damage of any kind incurred as a result of the use of any user content. Server administrators are solely responsible for establishing and enforcing content policies within their Discord servers.
You agree that any claim or cause of action arising out of or related to your use of the Service or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred. This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise. This provision does not apply where prohibited by applicable law, including mandatory consumer protection laws in the European Union or the United Kingdom.
By using the Service, you consent to receive electronic communications from Ticket King, including service announcements, administrative messages, and legal notices. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This consent to receive electronic communications applies to all interactions with the Service, and you may withdraw this consent only by ceasing to use the Service.
